Article 1 – Orders

1.1 Placing an Order

Orders can be placed 24 hours a day, seven days a week, at www.maisonaveni.com. By placing an order on the site, the Customer acknowledges the obligation to pay for the Products ordered once the order has been confirmed, subject to stock availability. The Customer also acknowledges that, because the order for the Products shown on the site is placed online, acceptance of these General Terms and Conditions of Sale does not require a handwritten signature. By checking the box marked “I have read and accept the General Terms and Conditions of Sale,” the Customer confirms that they have read and accepted these Terms.

1.2 Order Changes

The website’s ordering process allows the Customer to review and correct any errors before submitting the order. The Customer acknowledges having taken the time to read and review the order at each stage of the ordering process.

1.3 Order Confirmation

To confirm an order, the Customer must enter accurate personal and delivery details to avoid order errors. The Seller shall not be held responsible for errors in the Customer’s details, and the Customer shall bear any resulting delays, delivery errors, or additional shipping costs. By confirming an order, the Customer accepts these General Terms and Conditions of Sale. Once the Customer’s order is received, a confirmation email containing an order summary will be sent and will constitute acceptance of the order.

The contract between the Customer and the Seller is formed only when the confirmation email is received. Payment for the order by the selected method will be processed once the Seller has accepted the Customer’s order. The Seller undertakes to send the Customer another email when the order ships.

The Customer must also keep the contact information they have provided up to date so that the Seller can contact them about their order or the delivery of the Products.

1.4 Cancellation

Unfortunately, the Seller can no longer cancel an order once it has shipped. If the Customer changes their mind after the order has shipped, they may refuse delivery or return the Products to the Seller in accordance with the returns policy set out in clause 6 below. Shipping charges will apply in this case.

1.5 Verification

Before ordering Products, the Customer is responsible for checking that they can receive them. In particular, the Customer must make sure the Products will fit easily into the room of their choice, are suitable for that room, and that no other issue could complicate or prevent delivery.

Article 2 – Product Information

2.1 Description

maisonaveni.com sells furniture, textiles, and decorative accessories for living rooms, dining rooms, bedrooms, and beds. The features of the products offered to Customers are described accurately and with the utmost care on maisonaveni.com.

Product images on maisonaveni.com are for illustrative purposes only. Although the Seller makes every effort to display colors accurately, it cannot guarantee that the Customer’s computer will display colors accurately or provide a satisfactory representation of Product colors. As a result, the Products delivered may differ slightly from those shown in the images. Upon request, we will send you a sample of the product’s color free of charge.

2.2 Availability

Items on maisonaveni.com are sold subject to stock availability. Products not held in stock are sold subject to availability and the applicable supplier lead times. The availability of each product sold on maisonaveni.com is shown on its product information page.

Article 3 – Prices

Prices shown are in euros and include all taxes (TTC), but exclude delivery charges.

Maison Aveni reserves the right to change its prices at any time, but the price applicable to your order is the price in effect on the date it is placed. Delivery charges are shown when you confirm your cart.

Article 4 – Payment Terms

4.1 Payment Methods

The Customer may pay for their order online by card (Carte Bleue, Visa, Mastercard, etc.), by PayPal, or by bank transfer. Online payments are secured and guaranteed by Caisse d’Epargne. Maisonaveni.com ensures that no banking information passes through the online store by using SSL (Secure Socket Layer) payment security, which encrypts the Customer’s banking information during transmission over the network. The Customer can check that the transmission is encrypted by looking for a padlock symbol in the browser’s address bar. Maisonaveni.com reserves the right to request proof of identity and proof of address to ensure that no one is using another person’s banking information without their knowledge.

4.2 Installment Payments with Alma

Available for purchases from €100 to €3,000, in three or four interest-free installments. Offer available to adults residing in France with a Visa or Mastercard bank card.

Conditions:

This offer is available only to individuals of legal age residing in France who hold a Visa or MasterCard with an expiration date later than the end of their chosen financing period. Cards requiring systematic authorization, including Electron, Maestro, and Nickel cards, as well as e-cards, Indigo cards, and American Express cards, are not accepted.

Application terms:

After completing your order, simply click the “Pay in 3 or 4 installments with Alma by card” button. You will then be redirected to our partner’s Alma payment page, which displays a detailed summary of your order and a personalized financing application for you to confirm. Enter your personal information or, if you have an Alma account for payments in 3 or 4 installments, sign in using the credentials associated with that account. The terms and conditions for installment payments will be provided to you as a PDF so you can read, print, and save them before accepting them. You then indicate your electronic acceptance by checking the corresponding box.

You acknowledge that the “double click,” together with checking the box confirming that you have read the general terms and conditions, constitutes consent to enter into a contract and irrevocable, unconditional acceptance of the product’s general terms and conditions. Unless proven otherwise, the data recorded by Alma constitutes evidence of all transactions between you and Alma. If you apply for a financing solution offered by Alma, information relating to your order will be sent to Alma, which will use it to assess your application and to grant, administer, and collect the credit.

Alma reserves the right to approve or decline your application for financing in three or four installments through Alma. You have 14 days to withdraw from the credit agreement.

4.3 Invoice

The order confirmation or order form completed online by the Customer does not serve as an invoice. The Seller will send the Customer an invoice upon request at contact@maisonaveni.com.

4.4 Failure to Pay

The Seller reserves the right to suspend or cancel any order and/or delivery if the Customer fails to pay any amount due or if a payment fails. In addition, any order that has not been paid for in full remains the property of the Seller.

Article 5 – Delivery

5.1 Delivery Services

Products are delivered to the address provided by the Customer on the order form. The Customer must check that the information is complete and accurate before submitting it to the Seller. Maisonaveni.com shall not be held responsible for data entry errors or any resulting delays or delivery errors. If an error occurs, the Customer shall bear the full cost of reshipping the order.

Maison Aveni shall not be held responsible for delivery delays caused by disruptions or errors involving carriers.

5.2 Dispatch Times

Online orders are reviewed each day from Monday through Friday (excluding public holidays). Once an order is confirmed, the maisonaveni.com team prepares it within one to two business days (excluding weekends and public holidays). The carrier transit time stated below therefore begins once the shipping confirmation email has been received. If an order contains one or more unavailable products, it will ship once all items in the order are available. To receive available products sooner, the Customer may place unavailable items in a separate order. The Customer is automatically notified when the order ships.

5.3 Transit Times

The Customer can choose a transit time by selecting a delivery option when confirming the order. The Seller provides the Customer with the delivery times communicated by the selected carrier. Shipping costs are calculated in the cart based on the delivery option and location, and confirmed before the Customer finalizes the order.

5.4 Delivery Times

When the order is confirmed, maisonaveni.com informs the Customer of the home delivery date. For home deliveries requiring an appointment, the delivery date is confirmed when the delivery provider contacts the Customer within four days of the product being handed over to the carrier. Deliveries are made Monday through Saturday, depending on carrier availability and delivery area.

The delivery times shown are in business days and exclude weekends and public holidays.

5.5 Delivery Options

Maisonaveni.com offers four delivery options, depending on the Customer’s choice:

  • Delivery to Your Doorstep
  • Express Delivery to Your Doorstep
  • Premium Delivery to Your Floor
  • Premium Delivery to Your Floor + Assembly (Île-de-France region and departments 85, 44, 17, and 79 only)

5.6 Delivery Delays

If delivery is delayed, the Customer may contact After-Sales Service directly by phone or email. A claim or investigation will then be opened to locate the order. If 10 days have passed since maisonaveni.com sent the shipping notice, the Customer must report the packages as lost. The Seller will then handle the case and submit the necessary claims to the carrier. A carrier claim may take three to four weeks to resolve after it is opened.

If the package is found, it will be sent to the Customer immediately. If it is not found, maisonaveni.com undertakes, at its own expense, to resend the same product within the required timeframe or to refund the Customer the full amount paid. If the product to be resent is out of stock, the Seller will refund the amount paid for the product concerned.

5.7 Damaged Packages

The Customer must inspect the condition of the package in the carrier’s presence. If it is partially or completely damaged, the Customer must note the necessary reservations on the delivery slip. If the Customer notes no reservations, the package is deemed accepted, and its delivery may no longer be disputed. The Customer must also notify the Seller by email at contact@maisonaveni.com within 48 hours of receiving the order so that maisonaveni.com can take prompt action.

Article 6 – Withdrawal, Returns, and Furniture Take-Back

6.1 Statutory Withdrawal Period

Article L.221-16 of the French Consumer Code provides that the Customer has 14 calendar days from receipt or collection of the Items to notify maisonaveni.com of their intention to return an Item. A Customer exercising their statutory right of withdrawal under the prescribed conditions may receive a refund for the returned Items. Any refund will be made using the same payment method the Customer used for the initial transaction, no later than 14 days after the Customer exercises their right of withdrawal.

Article L.221-23 of the French Consumer Code provides that the right of withdrawal is exercised by returning the product and that the Customer bears the shipping costs. If the delivered Items do not conform to the Order, maisonaveni.com will bear all shipping costs.

6.2 Contractual Withdrawal Period

To help ensure customer satisfaction, maisonaveni.com accepts returns by mail to the address provided by Customer Service or shown on the delivery slip for the Item concerned, within a period longer than the statutory withdrawal period mentioned above. The Customer has fourteen (14) days from receipt of the order to withdraw and return the Items. Returns made after this period will not be accepted.

6.3 How to Exercise the Right of Withdrawal

A return request for one or more Items may be made by:

  • Or by emailing the withdrawal form below to contact@maisonaveni.com, or mailing it to Maison Aveni, Returns Department, ZAC de Bel Air, 17230 Andilly.

I hereby notify you of my withdrawal from the contract for the purchase of the goods listed below:

The maisonaveni.com team recommends returning products by registered mail or with additional insurance to ensure compensation, where applicable, up to their actual market value if they are stolen or lost. Package return address: Maison Aveni, ZAC de Bel Air 17230 Andilly

For returns to Maison Aveni, return costs are determined by the weight of the order to be collected. To request an estimate of return costs, please contact customer service directly

If the specified deadlines are not met, maisonaveni.com will be unable to refund the Customer.

Only Items returned in their original packaging and in perfect resale condition will be accepted. Returns of assembled, used, or damaged Items will therefore be refused. The right of withdrawal cannot be exercised if the delivered Items have been soiled, damaged, assembled, or used, even in part. Likewise, Items returned incomplete, damaged, or soiled by the Customer will not be accepted or exchanged.

Items must also be accompanied by the order number, either on the return form supplied with the delivered Items and signed by the Customer, or on another document. The Customer is advised that using the return form makes it easier for Maison Aveni to process the return and is therefore encouraged to use it. The Customer shall only be liable for any loss in value of an Item resulting from handling beyond what is necessary to establish the nature, characteristics, and, where applicable, proper functioning of the Items. Refunds following the exercise of the right of withdrawal will be made using the same payment method the Customer used for the initial transaction, unless the Customer specifies otherwise.

6.4 Exceptions to the right of withdrawal

Items made specifically at the Customer’s request (for example, a sofa in fabric chosen by the Customer) cannot be returned or exchanged because they are personalized.

6.5 AGEC Law and One-for-One Furniture Take-Back

Want to part with your old furniture? You have several options.

You can take your old furniture to one of Eco-mobilier’s 3,000 collection points or another suitable collection point. For more information, visit https://www.maisondutri.fr/livraison-et-reprise-de-votre-meuble/.

Better yet, you can donate it to a charitable furniture collection organization, such as Emmaüs Collecte, which will pick up your old furniture from your home free of charge. For more information, visit http://emmauscollecte.com/index.php/comment-faire-un-don-emmaus.

If your old piece of furniture weighs more than 25 kg, one of our carriers can take it away at no additional charge. It must be disassembled, properly packaged, and ready for collection before the delivery driver arrives. Under the “one-for-one” take-back law, the furniture collected must be in the same category as the item delivered. It must be approximately the same weight and dimensions, and of the same type. For example, if your old bed weighs more than 25 kg, we can collect it when you replace it with a new bed of the same dimensions ordered from us.

To arrange collection of your old furniture, please contact our customer service team before placing your order, by phone at 05 37 02 17 15 or by email at contact@maisonaveni.com. If you do not contact our customer service team before your order is shipped, we will not be able to accommodate your request.

Article 7 – Warranties, Complaints, and After-Sales Service

7.1 Statutory Warranties

Article L211-4 of the French Consumer Code states that the Seller’s products are covered by a supplier warranty specific to each product. If the Customer can provide evidence of a manufacturing defect, the Seller must take steps to bring the Item into conformity for the Customer in accordance with the following articles.

“Article L.211-4 of the French Consumer Code: The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when installation was the seller’s responsibility under the contract or was carried out under the seller’s responsibility. Article L.211-5 of the French Consumer Code:

To conform to the contract, the goods must:

  1. Be fit for the purpose ordinarily expected of similar goods and, where applicable: - match the description given by the seller and have the qualities presented to the buyer in a sample or model; - have the qualities that a buyer can reasonably expect in light of public statements made by the seller, the manufacturer, or its representative, particularly in advertising or on labels;
  2. Or have the characteristics agreed upon by the parties, or be suitable for any special purpose sought by the buyer, made known to the seller, and accepted by the seller. Article L.211-12 of the French Consumer Code: An action arising from a lack of conformity must be brought within two years of delivery of the goods. Article 1641 of the French Civil Code: The seller is liable under the warranty for hidden defects in the item sold that render it unfit for its intended use, or impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had they known of the defects. Article 1648 of the French Civil Code: An action arising from a defect giving grounds for rescission must be brought by the buyer within two years of discovering the defect.”

This warranty does not cover the following: misuse of the product or use contrary to its instructions, external or incidental causes, or work on the product by an unqualified repairer.

7.2 Complaints

All complaints must first be submitted to Customer Service by email or phone. Contact email: contact@maisonaveni.com - Phone: 05 37 02 17 15

Where applicable, a refund will be issued within 14 days of Maison Aveni receiving the Item, using the payment method chosen when the Order was placed. These provisions do not affect the right of withdrawal mentioned above.

Article 8 – Liability
